1. Agreement
By using prosofttaxsoftware.com or purchasing ProSoft packages or services, you agree to these Terms of Service (“Terms”). “You” means a tax professional or firm (B2B). Related policy: Privacy Policy.
2. Who we are / what we provide

We provide sales-assisted packages that typically include: access facilitation to TaxWise® and/or CrossLink® platforms (as applicable to your package), onboarding and training, bank-product enablement support via partner banks, and year-round human support — as described in your order or quote.
- We are not the publisher/owner of TaxWise® or CrossLink®.
- We are not the bank or lender for refund transfers or advances unless expressly stated in a signed agreement.
TaxWise® and CrossLink® are trademarks of their respective owners. ProSoft is an independent partner/provider of onboarding and related services.
3. Software / platform license (sales-assisted)
Platform licenses and access are governed by TaxWise® / CrossLink® end-user or provider agreements in addition to ProSoft’s service terms. ProSoft grants a limited right to use onboarding materials, support, and any ProSoft-provided tools included in your package.
There is no self-serve “clickwrap download equals ownership of TaxWise/CrossLink.” Fulfillment is sales-assisted. You may not reverse engineer ProSoft materials, share credentials without authorization, or violate IRS EFIN/ERO rules or platform acceptable-use policies.
4. Acceptable use
- Lawful professional tax-preparation business use only
- No scraping, abuse of forms, malware, or interference with the site or services
- No using the site to solicit illegal activity
- No misrepresenting bank-product eligibility to clients
- If chat/AI tools are added: do not rely on them as tax, legal, or credit advice
5. Billing and pricing
Marketed seasonal package prices (subject to change; confirm on quote):
- Web — $499: ProSoft package with platform access facilitation (per plan) plus onboarding/support
- Basic Install — $549: ProSoft package tier as described in current marketing/quote
- Pro Install — $650: ProSoft package tier as described in current marketing/quote
Prices are for ProSoft’s package / onboarding + platform-access tiers as described in the order form — not a claim that ProSoft owns the tax calculation engine. Taxes, third-party platform fees (if any), and bank/product fees are separate. Payment terms are stated on your invoice or order form.
6. Refunds / cancellations
Refund and cancellation terms are stated on your order form or written quote. Unless otherwise agreed in writing:
- A limited cooling-off or cancellation window may apply before provisioning
- After provisioning or after bank applications have started, certain items may be non-refundable
- Any “switch confidence” or satisfaction offer (if offered) applies only under its written conditions
Chargebacks and collections are handled under applicable law and your payment agreement.
7. Bank products — separate partner terms
- Refund transfers, advances, and related products are offered by partner banks/processors.
- Separate applications, eligibility, fees, and agreements apply.
- ProSoft marketing intake does not enroll you or your clients in bank products.
- ProSoft does not guarantee approval, fee collection, or IRS timing.
Bank-product disclosures for counsel review may be published separately; until then, ask your onboarding specialist for current partner terms.
8. No tax, legal, or credit advice
Website content, demos, chat, and support are not tax, legal, accounting, or credit advice. You remain responsible for returns you prepare and for client disclosures.
9. IRS / platform approval claims
“IRS-approved” or e-file capability language refers to the TaxWise® / CrossLink® platforms (and applicable provider status for the tax year), not a vague claim that “ProSoft software” is itself the approved engine unless separately true.
10. Warranties disclaimer
Services are provided “as available.” Platform uptime depends in part on TaxWise® / CrossLink® and bank partners. To the maximum extent permitted by law, ProSoft disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. Soften any marketing that sounds like an absolute guarantee.
11. Limitation of liability
To the maximum extent permitted by law, ProSoft’s total liability arising out of or related to the site or services is limited to the fees you paid to ProSoft in the twelve (12) months before the claim. ProSoft is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or lost data, except where such limitation is prohibited by law.
12. Indemnity
You agree to indemnify and hold harmless ProSoft from claims arising out of your misuse of the site or services, unlawful client solicitations, or inaccurate bank-product representations, to the extent permitted by law.
13. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Exclusive venue for disputes is the state or federal courts located in Palm Beach County, Florida, unless applicable law requires otherwise. Informal dispute resolution by email or phone is encouraged before filing a claim.
14. Changes to Terms
We may update these Terms by posting a revised version at /terms/ with a new effective date. Continued use of the site or renewal of services constitutes acceptance where permitted by law.
